The magistrate court sitting in Nkhata Bay district on May 30, 2017 has convicted and sentenced Thomas Silizo Chinyama to six years imprisonment with hard labour for the offence of breaking into a building and committing a felony therein.
Police prosecutor Sergeant Keston Chiona told the court that during the night of 20-21 March 2017, Chinyama broke into the warehouse of Kawalazi Estate Limited and stole one Honda sprayer, two nap sack sprayers, four pairs of gum boots and two overalls all valued at K983, 288.00
“Following investigations that were carried out, Police not only arrested Chinyama but also recovered the Honda sprayer. He was later charged with the offence of breaking into a building and committing a felony therein contrary to section 311 (1)”, said Nkhata Bay Police spokesperson Ignatius Esau.
Esau further said during his first court appearance, he pleaded not guilty to the charge and this prompted the state to parade five witnesses.
“On May 30, 2017, Chinyama was found guilty and in mitigation, he told the court that he looks after his grand parents, he also told the court that he is at pains to see that he is always a suspect whenever an offence happens around his area”, concluded Esau.
When passing sentence, First Grade Magistrate Anthony Banda told the court that it seems the convict who got released recently from jail for the offence of escaping from lawful custody didn’t learn his lesson when he was serving a two year jail term, as such he deserves to be given longer sentence.
“I therefore sentence Thomas Silizo to 6 years imprisonment with hard labour”, said Magistrate Anthony Banda.
Thomas Silizo Chinyama 24, hails from Thula village in the area of Traditional Authority ( TA ) Kabunduli in the distirict.
